Divorce

1. Divorce

If a foreigner who is married to a Korean wants to divorce the Korean, he or she can file a divorce suit in a Korean court, and if there are children, the court will jointly decide on the child's parental rights, custody, and interview rights.

Even after divorce, if you are raising a Korean child, you can claim child support from the other party.

2. Relationship between divorce and marriage visa (F-6)

In principle, a foreigner who is married to a Korean and is staying on a marriage visa (F-6) cannot stay on a marriage visa (F-6) if he or she gets divorced. However, in the case of divorce due to reasons attributable to Koreans, raising Korean children, or exercising the right to interview and negotiate with Korean children, as an exception, you can continue to stay in the country with a marriage visa (F-6).

Since the immigration office decides whether to extend the marriage visa (F-6) of divorced foreigners based on court rulings, etc., you must receive the help of a professional lawyer during the divorce proceedings to continue staying in Korea after divorce.
